1. INTRODUCTION AND ACCEPTANCE OF TERMS

1.1 Agreement Formation
These Terms of Use (“Terms,” “Agreement”) constitute a legally binding agreement between you (“User,” “you,” “your”) and The Fairfax County Crime Solvers, Inc., a Virginia non-profit corporation, trading as Crime Solvers of Fairfax County (“Company,” “we,” “us,” “our”), governing your access to and use of the website located at www.fairfaxcrimesolvers.org (the “Website” or “Service”). By accessing, browsing, or using any portion of the Website, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety, as well as our Privacy Policy, which is incorporated herein by reference.

1.2 Capacity and Authority
By accepting these Terms, you represent and warrant that: (a) you have the legal capacity and authority to enter into this Agreement; (b) if you are accepting these Terms on behalf of an organization, you have the authority to bind such organization to these Terms; (c) your use of the Website will not violate any applicable law, regulation, or ordinance; and (d) all information you provide to us is accurate, current, and complete.

1.3 Modification of Agreement
We reserve the right, in our sole discretion, to modify, update, or revise these Terms at any time. Your continued use of the Website after the effective date of any modifications constitutes your acceptance of the modified Terms. If you do not agree to any modifications, you must
discontinue use of the Website immediately.

2. DEFINITIONS AND INTERPRETATIONS

2.1 Key Definitions
For purposes of these Terms, the following definitions shall apply: “Anonymous Tip” means any information, report, or communication submitted through the Website without disclosure of the submitter’s identity, in accordance with Va. Code § 15.2-1713.1.

“Content” means all text, data, information, software, graphics, photographs, videos, audio files, and other materials available on or through the Website.

“Crime Solvers Program” of “Crime Stoppers Program” means the program operated in accordance with Va. Code § 15.2-1713.1 for the purpose of encouraging citizens to report information concerning criminal activity. Crime Solvers of Fairfax County is a member of Crime Stoppers USA. For purposes of this website, “Crime Solvers” and “Crime Stoppers” may be used interchangeably.

“Personal Data” has the meaning set forth in Va. Code § 59.1-575, referring to any information that is linked or reasonably linkable to an identified or identifiable natural person.

“User-Generated Content” means any content, information, data, text, photographs, videos, audio files, or other materials that you submit, post, upload, or otherwise make available through the Website.

2.2 Interpretation Rules
In these Terms: (a) headings are for convenience only and do not affect interpretation; (b) words in the singular include the plural and vice versa; (c) references to statutes include amendments and successor provisions; (d) “including” means “including without limitation”; and (e) any ambiguity shall not be construed against the drafting party.

3. ANONYMITY GUARANTEE AND CONFIDENTIALITY PROTECTIONS

3.1 Statutory Anonymity Protection
In accordance with Va. Code § 15.2-1713.1, we guarantee anonymity for all tip submissions made through our Crime Solvers Program. Your identity as a tipster will remain confidential and will not be disclosed except as may be required by court order after a judicial determination that disclosure is essential to the defense of an accused person and that such information cannot be obtained by other reasonable means.

3.2 Technical Anonymity Measures
We implement technical measures designed to preserve your anonymity, including: (a) no requirement for user registration or account creation for tip submission; (b) no collection of personally identifiable information during the tip submission process; (c) no tracking of IP addresses or device identifiers for anonymous tip submissions; and (d) secure transmission protocols that prevent interception of communications.

3.3 Freedom of Information Act Protection
Anonymous tip submissions are protected from disclosure under Va. Code § 2.2-3706, which exempts from mandatory disclosure records relating to criminal investigations and records that would identify persons providing information about crimes or criminal activities under a promise of anonymity.

3.4 Limitations on Anonymity Guarantee
While we guarantee anonymity for tip submissions, this guarantee does not extend to: (a) other uses of the Website that do not involve tip submission; (b) information voluntarily disclosed by you outside the anonymous tip submission system; (c) court-ordered disclosure following proper judicial proceedings; or (d) information that becomes publicly available through sources other than our disclosure.

4. DATA COLLECTION, PRIVACY NOTICE, AND CONSUMER RIGHTS

4.1 Minimal Data Collection Approach
Consistent with our commitment to minimal data collection, we collect only the personal data that is necessary for the operation of our Crime Solvers Program and Website functionality. We do not collect personal data for commercial purposes, advertising, or marketing activities.

4.2 Data Processing Purposes and Legal Basis
We process personal data only for the following purposes: (a) operating and maintaining the Website; (b) receiving and acknowledging donations; (c) registering participants for fundraising and other events; (d) facilitating the submission and processing of crime tips; (e) cooperating with law enforcement investigations; (f) complying with legal obligations; (g) protecting the safety and security of users and the public; and (h) improving Website functionality and user experience.

4.3 Data Retention and Deletion
We retain personal data only for as long as necessary to fulfill the purposes for which it was collected, comply with legal obligations, or as required for law enforcement investigations.

Anonymous tip information may be retained indefinitely for law enforcement purposes. Upon request, we will delete personal data unless retention is required by law or for legitimate law enforcement purposes.

4.4 Breach Notification
In accordance with Va. Code § 18.2-186.6, we will provide notice of any breach of personal information without unreasonable delay and, where feasible, within seventy-two (72) hours of discovery of the breach, unless the breach is unlikely to result in harm to affected individuals.

4.5 Government Data Collection Compliance
As an entity that may be subject to Va. Code § 2.2-3800 et seq., we ensure that any data collection practices comply with applicable government data collection and dissemination requirements, including proper authorization, purpose limitation, and security safeguards.

5. USER-GENERATED CONTENT AND CRIME TIP SUBMISSIONS

5.1 Anonymous Submission System
Our Website provides an anonymous submission system that allows users to submit crime tips and related information without revealing their identity. This system is designed to encourage public participation in crime prevention while protecting user privacy and safety.

5.2 Content Standards and Restrictions
All User-Generated Content must: (a) relate to legitimate criminal activity or suspicious behavior; (b) be factual and accurate to the best of your knowledge; (c) not contain false, misleading, or defamatory information; (d) not violate any person’s privacy, publicity, or other rights; (e) not contain obscene, pornographic, or otherwise inappropriate material; (f) not promote illegal activities or violence; and (g) comply with all applicable laws and regulations.

5.3 Prohibited Content
You may not submit content that: (a) contains personal attacks, harassment, or threats against any individual; (b) includes copyrighted material without proper authorization; (c) contains malicious code, viruses, or other harmful components; (d) attempts to impersonate another person or entity; (e) solicits personal information from minors; (f) promotes discrimination based on protected characteristics; or (g) interferes with the proper functioning of the Website.

5.4 Content Review and Moderation
We reserve the right, but assume no obligation, to review, monitor, edit, or remove any User-Generated Content at our sole discretion. We may remove content that violates these Terms, applicable law, or our community standards. However, we do not pre-screen content and are not
responsible for monitoring all submissions.

5.5 Limited Liability for Submissions
While we strive to facilitate effective crime reporting, we make no guarantees regarding: (a) the investigation or resolution of reported crimes; (b) the accuracy or completeness of information submitted by users; (c) the response time or actions taken by law enforcement; or (d) the outcome of any criminal proceedings that may result from submitted tips.

6. LAW ENFORCEMENT COOPERATION AND INFORMATION SHARING

6.1 Mandatory Cooperation Requirement
In accordance with Va. Code § 15.2-1713.1 and our mission as a Crime Solvers Program, we maintain full cooperation with law enforcement agencies, particularly the Fairfax County Police Department, in all matters relating to criminal investigations and public safety.

6.2 Information Sharing with Fairfax County Police Department
We will share information, including User-Generated Content and associated data, with the Fairfax County Police Department when: (a) such information relates to reported criminal activity; (b) sharing is necessary for criminal investigation or prosecution; (c) disclosure is required by law, court order, or legal process; (d) sharing is necessary to prevent imminent harm to persons or property; or (e) cooperation is requested for legitimate law enforcement purposes.

6.3 Scope of Information Sharing
Information that may be shared with law enforcement includes: (a) crime tip submissions and related content; (b) technical data necessary for investigation (excluding information that would compromise anonymity); (c) user communications that violate these Terms or applicable law; (d) evidence of illegal activity discovered through Website monitoring; and (e) any information required by legal process or court order.

6.4 Legal Process and Court Orders
We will comply with all valid legal process, including subpoenas, court orders, search warrants, and other lawful requests for information from law enforcement agencies, courts, and other governmental authorities. We may challenge overly broad or inappropriate requests where legally permissible.

6.5 Emergency Disclosure
We may disclose information without legal process when we believe in good faith that disclosure is necessary to: (a) prevent death or serious physical harm; (b) address emergencies involving national security; (c) protect children from abuse or exploitation; or (d) prevent or investigate serious criminal activity.

6.6 Preservation of Evidence
We will preserve relevant information and evidence as requested by law enforcement agencies and as required by legal hold obligations. This may include maintaining data beyond our normal retention periods when necessary for ongoing investigations or legal proceedings.

7. USER CONDUCT STANDARDS AND PROHIBITED ACTIVITIES

7.1 Acceptable Use Standards
Users must conduct themselves in accordance with applicable law and these Terms. Acceptable use includes: (a) providing accurate and truthful information; (b) respecting the rights and safety of others; (c) using the Website only for its intended crime-solving purposes; (d) maintaining the confidentiality of sensitive information; and (e) cooperating with reasonable requests from us or law enforcement.

7.2 Prohibited Activities
You are expressly prohibited from: (a) submitting false, misleading, or fraudulent information; (b) attempting to identify anonymous tipsters or compromise their anonymity; (c) using the Website for commercial purposes or personal gain; (d) harassing, threatening, or intimidating other users or third parties; (e) interfering with the proper functioning of the Website or its security measures; (f) attempting to gain unauthorized access to our systems or data; and (g) violating any applicable local, state, or federal law.

7.3 Computer Crimes and Fraud Prevention
In accordance with 18 U.S.C. § 1030 and Va. Code § 18.2-152.1 et seq., users are prohibited from: (a) accessing computers, networks, or data without authorization; (b) transmitting malicious code, viruses, or other harmful programs; (c) attempting to disrupt or damage computer systems or networks; (d) using the Website to facilitate computer fraud or abuse; (e) circumventing security measures or access controls; and (f) engaging in any form of cyber-attack or digital harassment.

7.4 Consequences of Prohibited Conduct
Violation of these conduct standards may result in: (a) immediate termination of your access to the Website; (b) removal of your content and submissions; (c) reporting of illegal activities to law enforcement; (d) cooperation with criminal investigations and prosecutions; (e) civil liability for damages caused by your conduct; and (f) legal action to enforce these Terms and protect our rights.

7.5 Monitoring and Enforcement
While we do not continuously monitor all user activity, we reserve the right to: (a) investigate suspected violations of these Terms; (b) review user submissions and communications; (c) cooperate with law enforcement investigations; (d) take appropriate action against violating users; and (e) implement additional security measures as necessary.

8. LIMITATION OF LIABILITY AND RISK ALLOCATION

8.1 Disclaimer of Warranties
THE WEBSITE AND ALL CONTENT, SERVICES, AND FUNCTIONALITY PROVIDED THEREIN ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, QUIET ENJOYMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

8.2 Limitation of Direct Damages
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE FAIRFAX COUNTY CRIME SOLVERS, INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF THE WEBSITE, REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

8.3 Cap on Total Liability
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE WEBSITE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100.00), REGARDLESS OF THE FORM OF ACTION OR THE BASIS OF THE CLAIM.

8.4 Exclusion of Certain Damages
IN NO EVENT SHALL WE BE LIABLE FOR: (a) ANY LOSS OR DAMAGE RESULTING FROM YOUR RELIANCE ON INFORMATION OBTAINED THROUGH THE WEBSITE; (b) ANY FAILURE TO INVESTIGATE, SOLVE, OR PROSECUTE CRIMES REPORTED THROUGH THE WEBSITE; (c) ANY ACTIONS OR OMISSIONS BY LAW ENFORCEMENT AGENCIES; (d) ANY BREACH OF ANONYMITY BY THIRD PARTIES; (e) ANY TECHNICAL FAILURES, INTERRUPTIONS, OR SECURITY BREACHES; OR (f) ANY CONTENT OR CONDUCT OF OTHER USERS.

8.5 Risk Assumption
You acknowledge and agree that: (a) use of the Website involves inherent risks, including potential exposure to inappropriate content or conduct by other users; (b) we cannot guarantee the accuracy, completeness, or reliability of user-submitted information; (c) criminal investigations and prosecutions are complex processes with uncertain outcomes; and (d) you assume all risks associated with your use of the Website and submission of information.

8.6 Basis of the Bargain
You acknowledge that the limitations of liability set forth in this Section 9 are fundamental elements of the basis of the bargain between you and us, and that we would not provide the Website without such limitations.

9. SERVICE DISCLAIMERS AND WARRANTY EXCLUSIONS

9.1 No Guarantee of Continuous Service Availability
We make no warranty or guarantee regarding the continuous availability, accessibility, or uninterrupted operation of the Website. The Website may be temporarily unavailable due to maintenance, technical difficulties, server outages, internet connectivity issues, or other factors beyond our reasonable control.

9.2 Technical Performance Disclaimers

WE DISCLAIM ALL LIABILITY FOR USER-GENERATED CONTENT, INCLUDING: (a) THE ACCURACY, COMPLETENESS, OR RELIABILITY OF USER SUBMISSIONS; (b) ANY DEFAMATORY, OFFENSIVE, OR INAPPROPRIATE CONTENT POSTED BY USERS; (c) ANY VIOLATION OF THIRD-PARTY RIGHTS BY USER CONTENT; (d) ANY HARM RESULTING FROM RELIANCE ON USER-SUBMITTED INFORMATION; AND (e) ANY ILLEGAL OR HARMFUL ACTIVITIES FACILITATED BY USER CONTENT.

9.6 Force Majeure Events
We shall not be liable for any failure or delay in performance of our obligations under these Terms that results from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, government actions, labor disputes, internet outages, or other force majeure events.

This preservation may continue indefinitely as required for law enforcement purposes.

11.4 Scope of Content Preservation
Preserved content may include: (a) all crime tip submissions and related information; (b) communications and correspondence; (c) technical data and metadata; (d) evidence of Terms violations or illegal activity; and (e) any other information that may be relevant to criminal investigations or legal proceedings.

11.5 Law Enforcement Access to Preserved Content
Preserved content will remain available to law enforcement agencies in accordance with applicable law and our cooperation obligations. Such access may occur through formal legal process or pursuant to ongoing investigative cooperation agreements.

11.6 Effect of Termination
Upon termination: (a) your right to access and use the Website immediately ceases; (b) you remain bound by all provisions of these Terms that by their nature should survive termination; (c) we may delete your account information and non-preserved content; and (d) all licenses granted by you to us continue in full force and effect.

12. USER INDEMNIFICATION OBLIGATIONS

12.1 Comprehensive Indemnification Duty
You agree to indemnify, defend, and hold harmless The Fairfax County Crime Solvers, Inc., its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, liabilities, damages, losses, costs, expenses, fees (including reasonable attorneys’ fees and court costs), and judgments arising out of or relating to: (a) your use of the Website; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; (d) your User-Generated Content; (e) your infringement of any third-party rights; and (f) any illegal activities or misconduct on your part.

12.2 Specific Indemnification Scenarios
Your indemnification obligations specifically include, but are not limited to, claims arising from: (a) submission of false, defamatory, or misleading information; (b) harassment, threats, or inappropriate conduct toward others; (c) violation of intellectual property rights; (d) breach of confidentiality or privacy rights; (e) computer crimes or unauthorized access attempts; (f) commercial use of the Website without authorization; and (g) any criminal activity facilitated through your use of the Website.

12.3 Defense and Settlement Rights
We reserve the right, at our option and expense, to assume the exclusive defense and control of any matter subject to indemnification by you. In such case, you agree to cooperate fully with our defense of such matter. You may not settle any claim subject to indemnification without our prior written consent.

12.4 Notice and Cooperation Requirements
You agree to: (a) promptly notify us of any claim or potential claim subject to indemnification; (b) provide reasonable cooperation and assistance in the defense of any such claim; (c) provide access to relevant documents and information; and (d) not take any action that would prejudice our defense or settlement of any claim.

12.5 Survival of Indemnification
Your indemnification obligations shall survive termination of these Terms and your use of the Website, and shall continue for the full period allowed by applicable law.

13. GOVERNING LAW AND JURISDICTIONAL PROVISIONS

13.1 Virginia State Law Governs
These Terms and any disputes arising out of or relating to these Terms or your use of the Website shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of laws principles.

13.2 Forum for Adjudication of Disputes
You agree that any legal action, suit, or proceeding arising out of or relating to these Terms or your use of the Website shall be brought exclusively in the state or federal courts located in Fairfax County, Virginia. You consent to the personal jurisdiction of such courts and waive any objection to venue in such courts.

13.3 Waiver of Jury Trial
TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU AND WE EACH WAIVE ANY RIGHT TO TRIAL BY JURY IN ANY LEGAL PROCEEDING ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE WEBSITE.

13.4 Statute of Limitations
Any claim or cause of action arising out of or relating to these Terms or your use of the Website must be filed within one (1) year after such claim or cause of action arose, or it shall be forever barred, except where a longer period is required by applicable law.
